1. Acceptance of Terms

By accessing or using the PipePeer website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. Using the website constitutes agreement to these terms.

2. User Eligibility

You must meet the following criteria to use our services:

  • Be at least 18 years of age or older
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and truthful information

Additional Requirements for Plumbers: Plumbers must hold a valid Kansas plumbing license and maintain current general liability insurance. Proof of license and insurance is required before receiving leads. Failure to maintain valid credentials will result in immediate termination of service.

3. Account Responsibilities

Users are responsible for:

  • Providing accurate, current, and complete information
  • Maintaining the confidentiality of any account credentials
  • All activities that occur under their account
  • Promptly notifying us of any unauthorized use

Plumber Responsibilities: Plumbers must respond to leads within 1 hour for emergency leads and within 24 hours for standard leads. Consistent failure to respond promptly may result in removal from the platform.

4. Prohibited Conduct

Users agree not to engage in any of the following prohibited activities:

  • Providing false, misleading, or inaccurate information
  • Harassing, abusing, or harming plumbers, customers, or PipePeer staff
  • Attempting to circumvent PipePeer's lead system or payment processes
  • Sharing, reselling, or transferring leads to third parties
  • Using the service for any illegal or unauthorized purpose
  • Interfering with or disrupting the security or operation of the website
  • Collecting or harvesting personal information of other users
  • Impersonating any person or entity

Violation of these prohibitions may result in immediate termination of your account and legal action.

5. Intellectual Property

All content on the PipePeer website, including but not limited to:

  • Text, graphics, logos, images, and icons
  • Website design, layout, and user interface
  • Software, code, and databases
  • The PipePeer name, logo, and branding

is the property of PipePeer and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, display, or create derivative works from any content without our express written permission.

Website Client Exception: Clients who purchase website services will own their completed website content and design upon final payment, as specified in their individual service agreement.

6. Payment Terms

ALL PAYMENTS ARE DUE UPFRONT before any work begins or leads are delivered. No exceptions.

Lead Payments

  • First lead is free for new plumbers
  • Subsequent leads must be paid for before delivery
  • Monthly unlimited plans are billed upfront each month
  • No refunds after lead has been delivered

Website Payments

  • Website build fees are paid 100% upfront before work starts
  • No refunds after work has begun
  • Monthly hosting and maintenance fees are billed in advance

All payments are processed through secure third-party processors (Stripe/PayPal). You agree to provide current, complete, and accurate billing information.

7. Lead Exclusivity

PipePeer provides exclusive leads to plumbers. By using our service, plumbers agree to:

  • Not share leads with other plumbers or third parties
  • Not resell leads to other service providers
  • Not use lead information for marketing purposes beyond servicing the specific request
  • Maintain confidentiality of customer information

Violation of lead exclusivity terms will result in immediate account termination and potential legal action.

8. Disclaimer of Warranties

THE PIPEPEER WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the service will be uninterrupted, timely, secure, or error-free
  • Warranties regarding the quality, accuracy, or reliability of any information obtained through the service

No Guarantee of Results: We do not guarantee that you will obtain any specific number of leads, customers, or revenue through our service. Results vary based on market conditions, competition, and other factors.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PIPEPEER, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, goodwill, or use
  • Personal injury or property damage
  • Any other intangible losses

Our total liability to you for all claims arising from or relating to these Terms or your use of the service is limited to the amount you paid to PipePeer in the twelve (12) months preceding the event giving rise to liability.

10. Indemnification

You agree to defend, indemnify, and hold harmless PipePeer, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the website and services.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions.

Binding Arbitration: Any dispute arising out of or relating to these Terms or the services shall be resolved through binding arbitration in Wichita, Kansas, conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding. You waive any right to participate in class action lawsuits or class-wide arbitration.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the website after any changes constitutes acceptance of the new Terms. It is your responsibility to review these Terms periodically.

13. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the service will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

15. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by us on the website, shall constitute the entire agreement between you and PipePeer concerning the website and services.
